Estate planning in a post-Windsor world requires special attention. It is said that all marriages will end – either by death or divorce. However, for some same-gender spouses, divorce may not be available and their status as spouses may not be recognized for some purposes. Other same-gender couples will prefer to remain “committed couples” and not marry for tax or non-tax reasons. This session will address estate planning tools for “recognized” and “non-recognized” same-gender spouses under the uncertain current “patchwork” of federal and state laws, and the impact of such laws on existing estate plans for both same-gender spouses and committed couples.
